Eligible Referrals

Each person who, in any month during the period during the period 15 May 2009 to 15 May 2010 (or such later date to which this arrangement may be extended by Fundit) (“ RAF Comission Payment Term”:

• Is a New Zealand resident or citizen and at least 18 years of age;
• Is not currently, and has not previously been, a registered Fundit user;
• Registers as a Fundit user on www.fundit.co.nz and nominates an existing registered Fundit user as their referrer when registering; and
• Applies for, is offered and accepts a loan under the Fundit on-line loan auction system and draws down that loan, such that Fundit receives a fee or commission payment in respect of that loan from the winning lender (“Eligible Loan”).
  

Eligible Referrers

Only one person may be nominated as an Eligible Referrer in respect of each Eligible Referral.

Each person who, during the RAF Commission Payment Term, is registered as a Fundit user and who an Eligible Referral has nominated as their referrer when registering with Fundit will be entitled to receive a Referral Commission in respect of each Eligible Loan as follows:

Additional Terms and Conditions

Fundit acknowledges and agrees that an Eligible Referrer has no liability or responsibility in respect of any loan application made, or any other information provided, by any person whom he or she refers Fundit to, or in respect of any Eligible Loan.

An Eligible Referrer is not an employee or agent of Fundit and cannot make any representation or warranty in respect of Fundit or in any way bind it contractually or otherwise. The Eligible Referrer acts solely as an independent contractor.

In making any referral to Fundit, the referrer shall comply with all applicable laws and not make any knowingly false statement concerning Fundit or its business or operations.

Fundit’s decision as to all matters, including Eligible Referrals, Eligible Referrers, Eligible Loans and the Referral Comission, shall be final and no correspondence will be entered into.

Only one Referral Commission will be paid in respect of each Eligible Loan.

To preserve privacy, an Eligible Referrer who is entitled to receive a Referral Commission will be:

• notified by email or phone solely that a person who he/she has referred has drawn a loan and the amount of his/her entitlement to a Referral Commission, but no other particulars; and
  
• paid that amount to an account nominated by the Eligible Referrer within 10 working days of receipt by Fundit of its commission on the Eligible Loan.

Fundit reserves the right to, from time to time, negotiate different rates with and applying only to particular Eligible Referrers .

Fundit will not be liable in respect of any commission payment lost or stolen in transit, or any late, lost, stolen or misdirected mail.

In the event of the occurrence of any event or circumstances beyond the reasonable control of Fundit adversely affecting its ability to conduct or participate in this commission payment arrangement, Fundit may cancel and/or recommence it with or without notice.

References to Fundit, where the context admits or requires, refers to Fundit Holdings Limited, Fundit Limited (and their respective directors and employees) and/or  www.fundit.co.nz , as the case may be.

All commissions are inclusive of GST (if any)

Eligible Referrers must take and rely upon their own legal, tax and other advice in taking any steps or action, the receipt of commissions paid, or otherwise,  in relation to this arangment 

New Zealand law applies.
